Welcome to Book Marked. These Terms of Service (“Terms”) govern your use of our website and online store (the “Services”), operated by Book Marked and powered by Shopify. By accessing or using the Services, you agree to be bound by these Terms.

1. About Book Marked

Book Marked sells curated mystery book bundles within New Zealand. Each bundle contains surprise items selected by us. By purchasing, you acknowledge the surprise and variability of the contents.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Have the legal capacity to enter into a binding agreement

3. Orders

When you place an order with us:

  • You agree that all information provided is accurate.
  • Order acceptance occurs once payment is processed and you receive confirmation.
  • We may cancel an order at our discretion (e.g., stock issues, suspected fraud).

If your order is cancelled, you will be refunded in full.

4. Pricing & Payment

All prices are listed in New Zealand Dollars (NZD) and include GST (if applicable).
We reserve the right to change prices at any time.

Payments are processed securely through Shopify or approved third-party providers. Book Marked does not store your full card details.

5. Shipping

We ship within New Zealand only, using NZ Post tracked services.

  • Lost or delayed parcels
  • Return-shipping requirements

By placing an order, you agree to the terms of our Shipping Policy.

6. Returns, Refunds & Consumer Rights

Your rights are protected under the Consumer Guarantees Act 1993 (CGA).

Change of mind

Because our products are mystery bundles, we do not offer returns or refunds for change of mind or preference.

Faulty or damaged items

If an item arrives faulty or damaged, or if we make a mistake with your order, we will meet our obligations under the CGA by offering a repair, replacement, or refund.

7. Accuracy of Content

We aim to provide accurate product descriptions and information, but we do not warrant that all content on the site is complete or error-free.
We may correct errors or update information at any time.

8. Intellectual Property

You may not copy, reproduce, or distribute any content without written permission.

You agree not to use our Services for:

  • Abusive, misleading, or harmful activities

Our store is hosted by Shopify, which provides e-commerce tools, payment processing, analytics, and technical support.

We are not responsible for third-party websites or content accessed via links from our site.

To the maximum extent permitted by New Zealand law:

  • Book Marked is not liable for any indirect, incidental, or consequential losses arising from your use of the Services.
  • Nothing in these Terms limits your rights under the Consumer Guarantees Act.
